Terms of service

These terms apply to the website fk-audiosuite.com, to the downloads offered here and to buying Pro licenses of the FK plugins. Provider is FK-Onlineservices UG (haftungsbeschränkt), Ebbingsdiek 1, 46325 Borken, Germany (see legal notice), in the following "we".

1. What we offer

• FK Audio Suite, a digital audio workstation for Linux and Windows. It is free software under the GNU General Public License version 3 and free of charge.
• FK plugins (currently FK Rig; further plugins are announced on the plugins page) as VST3 plugin and standalone application. Each plugin has a free Lite version. A Pro license unlocks the full range of the same installed plugin; no second download is needed.

Prices, scope and system requirements are shown on the pricing page and on each plugin's page. Please check the requirements with the free Lite version before buying: it is the same plugin.

2. Ordering through Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

The purchase contract is concluded between you and Paddle (Paddle.com Market Ltd, London, United Kingdom). Paddle's Buyer Terms apply to the purchase, including payment, invoicing, taxes and your statutory right of withdrawal. Prices are shown at checkout in your currency, including VAT where it applies.

3. Delivery

The Pro license is delivered digitally: right after the payment you receive a license key by e-mail, usually within a minute. You enter it in the plugin (see activate Pro). If the e-mail does not arrive, write to us; we send the key again.

4. License

How you may use the plugins is set out in the license terms. In short: a Pro license is personal, does not expire and may be used on all your own computers. FK Audio Suite itself is under the GPLv3; these terms do not restrict it.

5. Refunds

Within 14 days of buying you can get your money back without giving a reason. Details are in the refund policy. Your statutory rights remain unaffected.

6. Beta versions

Versions marked as beta are still being developed. Features, sounds and the look of the plugins can change with updates. Updates of the same major version are included in a Pro license.

7. Warranty and liability

The statutory warranty rights apply to purchases.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence we are liable only for the breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), limited to the damage that is typical and foreseeable for this kind of contract.

For the software we provide free of charge (FK Audio Suite, Lite versions), we are liable only for intent and gross negligence, as far as the law permits. Please keep backups of your projects.

8. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the country in which you have your habitual residence. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

Should a provision of these terms be invalid, the remaining provisions stay effective.
